ค้ำประกัน

From ค้ำ (kám, “to maintain; to support”) +‎ ประกัน (bprà-gan, “to ensure; to guarantee; to secure”).

Probably first used on 11 November 1923, when the first book of the Civil and Commercial Code of Thailand was promulgated.

ค้ำประกัน • (kám-bprà-gan)

1. (law) suretyship.
   • 1926, พระราชกฤษฎีกาให้ใช้บทบัญญัติแห่งประมวลกฎหมายแพ่งและพาณิชย์ บรรพ ๑ และบรรพ ๒ ที่ได้ตรวจชำระใหม่ ลงวันที่ ๑๑ พฤศจิกายน ๒๔๖๘:

     มาตรา ๖๘๐ อันว่าค้ำประกันนั้น คือ สัญญาซึ่งบุคคลภายนอกคนหนึ่งเรียกว่า ผู้ค้ำประกัน ผูกพันตนต่อเจ้าหนี้คนหนึ่งเพื่อชำระหนี้ในเมื่อลูกหนี้ไม่ชำระหนี้นั้น

     Section 680 As for suretyship, it is a contract by which a third person, called surety, binds himself to an obligee with the performance of an obligation when the obligor fails to perform it.

ค้ำประกัน • (kám-bprà-gan) (abstract noun การค้ำประกัน)

   • ค้ำประกันลูกหนี้

     kám-bprà-gan lûuk-nîi

     To serve as a surety for a debtor

   • ค้ำประกันการกู้ยืม

     kám-bprà-gan gaan-gûu-yʉʉm

     To serve as a surety for a loan; To subject a loan to a suretyship

• Both the noun and verb are colloquially shortened as ค้ำ (kám).
