The Bihar Legislative Assembly, also known as the Bihar Vidhan Sabha, is the lower house of the bicameral legislature of the Indian state of Bihar.

History

The Bihar Legislative Assembly came into existence in 1937.[1] The Assembly had a strength of 152 members. According to the provisions of the Constitution of India, the first General Elections in the state were held in 1952.[2] The total strength of membership in the Assembly was 331, including one nominated member. Dr. Shri Krishna Singh became the first Leader of the House and the Chief Minister, Dr. Anugrah Narayan Singh was elected the first Deputy Leader of the Assembly and became state's first Deputy Chief Minister. It was reduced to 318 during the second General Elections. In 1977, the total number of elected members of the Bihar Legislative Assembly was further raised from 318 to 324. With the creation of a separate State of Jharkhand, by an Act of Parliament titled as the Bihar Reorganisation Act, the strength of the Bihar Legislative Assembly was reduced from 324 to 243 members. The current NDA government formed on 27 July 2017 consists of 70 JD(U), 53 BJP, 2 LJP, 2 RLSP and 4 Independent MLA's.

Working

The Bihar Legislative Assembly is not a permanent body and subject to dissolution. The tenure of the Legislative Assembly is five years from the date appointed for its first sitting unless dissolved sooner. Members of the Legislative Assembly are directly elected by the people.

There are three sessions (Budget session, Monsoon session, Winter session) every year.

The Sessions of Legislative Assembly are presided by Speaker. The Speaker certifies that whether a bill is ordinary bill or money bill. Generally he does not participate in voting but he casts his vote in the case of tie. Vijay Kumar Chaudhary is the current Speaker of Bihar Legislative Assembly. The Legislative Assembly also has a Secretariat which is headed by Secretary. He is under the disciplinary control of Speaker. The function of Secretary is to assist the Speaker. Bateshwar Nath Pandey is the current Secretary of Bihar Legislative Assembly.

Current Assembly

Current assembly elections were held in October–November 2015. In July 2017, ex Deputy Chief Minister Tejashwi Yadav of the RJD was charged by the CBI in a corruption case. After prolonged, but ultimately futile deliberations between the members of the Grand Alliance over Yadav resigning, Nitish Kumar resigned as Chief Minister on the 26 July 2017.

Hours after Nitish Kumar's resignation, the JD(U) joined hands with the BJP, allowing Nitish Kumar to take oath as the Chief Minister of Bihar. The Governor of Bihar, Keshari Nath Tripathi, administered Kumar the oath of office and secrecy in the Bihar Raj Bhavan on 27 July 2017, 1000 hrs IST, making Kumar the Chief Minister of Bihar for the sixth time.[3] He gained the vote of confidence in the house with a total of 131 votes through Lobby Division voting on 28 July 2018. The Speaker (JD(U)) & 1 member of BJP did not cast their vote.
