The State Property Issues Committee of Azerbaijan Republic (Azerbaijani: Azərbaycan Respublikasının Əmlak Məsələləri Dövlət Komitəsi) is a governmental agency within the Cabinet of Azerbaijan in charge of regulation of property issues and policies in Azerbaijan Republic. The ministry is headed by Karam Hasanov.

History

The committee was established on May 19, 2009 by the Presidential Decree on the basis of the existing State Property Management Committee, to improve and facilitate privatization procedures for state owned properties. The statute of the committee was approved on June 24, 2009.[1]

Structure

The committee is headed by its Chairman aided by two deputees and Head of Administration. [2] Main functions of the committee are management of state property, its privatization, attracting external investment; conducting activities to increase effectiveness of state properties within and outside of the Azerbaijan Republic; maintaining inventories of state property and their registrations; holding events to promote privatization of cretina state properties auctioned for sale; provision of support for their further activities to state properties which were privatized; appraisals, assessment and pricing of real estate including personal properties and business buildings.[1]

One of the main structural units of State Committee on Property Issues of Azerbaijan is Central Office which consists of 15 structural divisions. In addition the Committee has Auctions Center which organizes the auctions, Department of privatization and lease of state-owned property, Department of Strategic Planning, Innovation, Monitoring and Analysis, State Service for Registration of Real Estate and its regional offices, Department on management and effective use of state property, Real Estate Cadastre and Technical Inventory Center, Information Technology and Management Center, Production and Management Center, as well as “Mulkiyyet” newspaper and “Dashimaz Emlak” journal.

Rights of the Committee

The Committee has rights to prepare drafts of legislative acts, as well as to participate in preparation of them, to issue orders, to get information from relevant organizations, local executive bodies, juridic and physical entities. The Committee can cooperate with corresponding international organizations, relevant state bodies of other countries, study their experience; carry out analysis, researches, prepare analytic materials and submit proposals. In order to develop and implement the issues which are in its authority, State Committee on Property Issues of Azerbaijan can sign contracts with foreign and local experts, as well as local and international advisory companies; use the budget of the Committee for the services for its subordinated bodies; participate at the court on its behalf; for exercising of its powers in a defined manner, establish subordinate bodies with juridical person status. It also has rights to publish newsletters reflecting its activity.

Duties

State Committee on Property Issues of Azerbaijan is responsible for ensuring of implementation of state programs on management and privatization of state property, state enterprises rehabilitation, and state registry of real estate, implementation of normative regulation, issue order, and attracting investments into relevant organizations which are open for privatization. Coordinating relevant executive bodies, state enterprises and organizations` activities regarding with management and privatization of state property, carrying out privatization of state property and to supervising observation of the terms and conditions of purchase-sale agreements signed between the Committee and the buyers of state property are carried out by relevant departments of the Committee. Monitoring and research works of state enterprises are conducted by the Committee. It also makes proposals related to preparation of depreciation norms of major funds of Azerbaijan. At the same time State Committee on Property Issues of Azerbaijan organizes creation of inventory list of state property, and prepares statistical reporting templates, studies productive use of state property.

International cooperation

Bilateral cooperation

On April 15, 2015, the Ambassador of the United States of America to Azerbaijan, met with the Chairman of the SCA in order to develop bilateral cooperation. At the meeting the cooperation between Mexico and Azerbaijan within the framework of the initial acquaintance and functions of the Committee was discussed. At the same time, the sides exchanged views on the establishment of cooperation with state bodies operating in accordance with the SCC mandates in Mexico, as well as exchange of knowledge and experience on related fields, mutual visits, assistance in the implementation of cooperation in other areas.

In order to regulate land relations, to improve the real estate registration system, as well as to apply modern technologies in the field of land cadastre and mapping, Tajikistan's Real Estate Registration and Cadastre Agency sent its specialists to Azerbaijan in 2016. In this regard, on 07-11 March 2016, trainings on relevant topics were organized for the experts of the Republic of Tajikistan in REDR.

The Cadastre, the Real Estate Registration and Mapping Agency of the Netherlands and the Land Cadastre and Mapping Agency of Austria signed memorandum of Understanding with State Committee on Property Issues of Azerbaijan for the registration of property rights on real estate and property, as well as for the establishment of bilateral cooperation in the field of cadastral activity. Memorandum projects are under consideration. At the same time, proposals were made to establish cooperation relations with relevant government agencies in Ukraine, Georgia and Moldova in the field of cadastre and real estate registration.

Suggestions on expanding international cooperation (subheading)

Improvement of the regulatory framework for the activities of the Committee, including the use of land resources, state regulation of the land market, state registration of rights over immovable property, the unified state cadastre, real estate state land cadastre, privatization and lease of state-owned lands and comparative analysis of the real estate management and privatization systems of the Commonwealth of Independent States, Eastern Europe and the Baltic States, as well as international organizations, including property and other rights related to the state land, in line with international experience, and systematized Suggestions are ready rings.

Cooperation with international and regional economic organizations

At the invitation of the "Cityscape Global" Union Companies, a delegation led by the Chairman of the State Committee on Property Issues of Azerbaijan visited Dubai, United Arab Emirates, on September 5-6, 2016. The purpose of the visit was to discuss real estate market, real estate issues in various aspects, as well as take part in the adoption of regulatory and technical principles of real estate management. In parallel the Committee cooperates with the United Nations Economic Commission for Europe (ECA) and AIC's Real Estate Management Working Group. Thus, a number of draft documents related to the Working Group's activities were prepared and submitted to the Working Group Bureau, the relevant member states and the UN Economic Commission for Europe.

At the same time, the employee of the State Committee on Property Issues of Azerbaijan chaired the UNECE Housing and Property Management Committee's session on September 13-14, 2007 at the 77th session of the Swiss Confederation in Geneva, held discussions among representatives of 56 member states and made 5 different presentations. As a result of the open voting held at the end of the session, the Committee's employee was elected the First Deputy Chairman of the UN House of the United Nations House of Housing and Property Management Committee, along with the head of the UNECE Intergovernmental Working Group on Real Estate Management and its Bureau.

Representative of the Committee participated in the 14th session of the Subcommittee on Trade, Economic and Related Legal Affairs of the European Union (EU) held on 27 September 2016 in Baku in the field of state property management and privatization, made a presentation on the issue and answered the questions of EU experts. The member of the Committee took part in the next meeting of the Working Group established within the WTO accession process in Geneva and made a detailed presentation on the privatization policy implemented in Azerbaijan and answered questions from WTO members.

The Committee cooperates with EuroGeographics international organization, which has extensive experience and collaboration network in accelerating work on various aspects of cadastral profile. On May 27, 2016, a meeting was held in the Committee with the KfW Bank's mission manager for the Real Estate Registration Project. In addition, the German International Cooperation Agency initiated a Memorandum of Understanding between the SCME, the Ganja City and the Sheki District Executive Powers and the relevant municipalities in order to ensure the exchange of cadastral information, as well as other issues raised by the Committee.

International trainings

A representative of the Committee took part in training courses held in Malaysia on "Land Assessment" from July 25-August 19, 2016 by the Malaysian Technical Cooperation Program. On 27 September 2016 a GIZ expert from Germany organized a seminar on "Experience of European Countries and Germany in the Real Estate Registration" in Baku for the staff of the State Real Estate Registration Service under the Committee.

Representatives of the Committee participated in the trainings held in Shaki and Ganja cities within the framework of the "Support to Civil Service Training Capacity Building Project", implemented jointly by the Civil Service Commission under the President of the Azerbaijan.

Business travels of the Committee Members

Seven staff members of the Committee made 10 business trips and 1 training visit to 10 foreign countries. These countries include the United States, the Republic of Romania, the Austrian Republic, the Swiss Confederation, the United Arab Emirates, Turkmenistan, the Russian Federation, the Republic of Kazakhstan, the Republic of Malaysia and the Republic of Slovenia.

Baku real estate and investment exhibition

The Second International Real Estate and Investment Exhibition of Azerbaijan organized by the State Committee on Property Issues was held at Baku Expo Center on 22-24 November 2016.
