The public beach is now closed. The town of Rochester Massachusetts maintains Mary's Pond Road. The State of Massachusetts oversees the water in Mary's Pond and keeps the pond stocked with fish. But who owns the beach? For most of the 20th century, Mary's Pond was a prime beach location for South-Eastern Massachusetts residents. It was always assumed that the Mary's Pond beach belonged to Plymouth County. Plans were laid by Rochester town officials to create a recreation area at Mary's Pond. As it turns out, a title search was made before the recreational area plans could proceed, months later it was discovered that since 1925 the beach at Mary's Pond has belonged to members of the Hiller family. The public beach at Mary's Pond never was public... and now it is closed.[1]
