Richard Darby is an American lawyer and an Associate Justice of the Oklahoma Supreme Court.

Education

Darby earned his Bachelors of Science in political science from Southwestern Oklahoma State University and his Juris Doctor from the University of Oklahoma College of Law.[1]

Prior to his appointment to the Supreme Court he served as a state district court judge from 1994–2018.[2] Before that, he served as a special judge and an associate district judge in Jackson County, Oklahoma.[3]

Service on Oklahoma Supreme Court

On April 5, 2018, Governor Mary Fallin appointed Darby to the Oklahoma Supreme Court to fill the vacancy created by the retirement of Joseph M. Watt.[2][4]

The first case to come before Justice Darby after being seated on the Supreme Court involved a suit by CompSource and the Oklahoma Association of Electric Self Insurers Fund against the Oklahoma Tax Commission (OTC). CompSource operates Oklahoma's Multiple Injury Trust Fund (MITF), which is a risk pool for insurers and self-insured companies in the state. MITF provides money to workers who have already been suffered a work-related injury, then has been injured a second time and are no longer able to work. Thus, the first employer is not held liable for payment of the total disability. Funds to sustain MITF are handled by payments through the OTC.[5]

In 2015, OTC denied the normal reimbursement for CompSource from MITF. The OTC ruled that Governor Mary Fallon had repealed these reimbursements through a 2015 executive order. In June 2018, the Supreme Court ruled 7-2 that the rebates had not been repealed, and ordered OTC to pay the plaintiffs. The court denied the plaintiffs' request for payment of interest on these funds. Justice Darby concurred with the majority decision.[5]


Personal

Darby has been married for 36 years to Dana Darby, Ph.D, who is superintendent of Altus Christian Academy. They have two sons: Ben, a communications officer for the Oklahoma Highway Patrol, and Jon, a student at Universal Technical Institute in Irving, Texas.[1]
